Product Use Context
These Terms apply to Happy Cans Sort in the context of its app presentation. The theme and interface are part of the app experience and do not create external ownership or transferable rights unless a separate official notice says so.

Third-Party Login: You may connect your Happy Cans Sort account to Google Play Games. Your use of those services is subject to Apple's or Google's terms.

Player Rules

Coins, Gems, and Virtual Items
Some features of Happy Cans Sort involve virtual currencies and collectible items. This section governs their use.
Important: Virtual currency and items have no real-money value. They are digital licenses for in-game use only and cannot be exchanged for cash.
Acquiring virtual currency or items grants you a revocable license to use those game features — not ownership of any digital property.
AVSEI Foundation reserves the right to modify the virtual economy, including prices and availability. Purchased items may not retain the same utility after game updates.
Account Termination: Virtual currency and items are non-refundable and non-transferable if your account is terminated for cause.
You may not sell, trade, transfer, or gift virtual items or currency to other players outside of explicit in-game mechanics.

Protecting Our Creative Work
Everything in Happy Cans Sort — from the artwork to the code — is owned by or licensed to AVSEI Foundation.
The Application and all game content (art, music, text, code, characters, trademarks) are the exclusive property of AVSEI Foundation or its licensors, protected by copyright and other laws.
What You May Do
You may:
- Share screenshots and videos of your gameplay on social media for personal, non-commercial purposes
- Stream your gameplay on platforms like YouTube or Twitch (subject to platform terms)
- Discuss and review Happy Cans Sort in fan communities
- Sell, redistribute, or commercially exploit Happy Cans Sort's content
- Create unauthorized merchandise featuring our characters or art
- Claim ownership of our content
- Remove copyright or trademark notices
- Use our trademarks without written permission

Limitation of Liability

AVSEI Foundation will not be liable for any indirect, incidental, consequential, or punitive damages — including loss of data, lost profits, or service unavailability — whether based on contract, tort, or other legal theory.
Maximum Liability: AVSEI Foundation's total liability to you for any cause of action is limited to the greater of your payments to us in the prior 12 months or USD $100.
Exceptions: These limits don't apply to liability that cannot be excluded under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by our negligence.
Why These Limits Exist: Reasonable liability caps allow us to offer Happy Cans Sort affordably. They are negotiated terms that reflect a fair allocation of risk.
Consumer Protection Laws: Mandatory consumer protection rights in your jurisdiction are not affected by these limitations.

Indemnity
By using Happy Cans Sort, you agree to the following indemnification obligation.
You agree to indemnify and hold harmless AVSEI Foundation and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, and costs — including reasonable attorney's fees — from: (a) your Terms violations; (b) your Happy Cans Sort use; (c) your content; (d) your law violations.
We may choose to handle the defense of indemnified claims ourselves. If we do, you agree to cooperate fully and not to settle the claim without our written consent.
We will promptly notify you of any claim subject to indemnification and work with you in good faith to resolve it fairly.

Dispute Resolution
Before resorting to formal legal proceedings, we ask that you follow this dispute resolution process.
Most disputes can be resolved with a simple conversation. Please email our support team first. If we can't resolve your issue within 30 days, you may proceed to formal dispute resolution.
Arbitration (Where Permitted): Disputes not resolved informally will be submitted to binding arbitration on an individual basis. Class-action arbitration is not permitted.
No Class Actions
You agree to resolve disputes with AVSEI Foundation on an individual basis only. You waive any right to participate in class action or group proceedings.
Exceptions: Either party may seek emergency injunctive relief from a court of competent jurisdiction. Individual small claims actions are also exempt from this arbitration agreement.

Account Termination
This section covers both voluntary account closure and AVSEI Foundation's right to terminate access.
You have the right to stop using Happy Cans Sort and close your account at any time without penalty. Email our support team to request account deletion.
We May Terminate Your Access
AVSEI Foundation may suspend or terminate your access, with or without notice, for: serious or repeated Terms violations, fraudulent activity, harmful conduct affecting other players, or as required by law.
After Termination:
- Your license to use Happy Cans Sort ends immediately
- Virtual items and currency in a terminated account are non-refundable
- Sections of these Terms that should survive (like IP rights, indemnification, and dispute resolution) remain in effect
Service Shutdown: AVSEI Foundation reserves the right to discontinue Happy Cans Sort entirely. We'll provide reasonable advance notice of any planned shutdown.

Jurisdiction and Choice of Law
This section tells you which country's laws apply to these Terms and any disputes.
This Agreement is governed by applicable law in AVSEI Foundation's jurisdiction of incorporation, excluding its conflicts of law provisions.
For disputes not subject to arbitration, courts in AVSEI Foundation's jurisdiction have exclusive authority. You agree to their jurisdiction.
Nothing in this section removes rights under mandatory consumer protection laws in your jurisdiction.

Terms of Service Updates
We may update these Terms as Happy Cans Sort evolves. Here's our commitment to fair and transparent communication about changes.
We distinguish between material and minor changes. For material updates (new data practices, new fees, IP rights changes), we provide at least 14 days of advance notice via in-app notification.
Changes take effect on the date specified. Continuing to use Happy Cans Sort after that date means you accept the updated Terms.

Force Majeure: AVSEI Foundation is not liable for failures or delays caused by circumstances beyond our reasonable control — including natural disasters, government actions, cyber attacks, or internet infrastructure failures.
You agree that a digital acceptance of these Terms is legally binding in all jurisdictions that recognize electronic agreements.

Player Safety
Some individuals are sensitive to flashing lights or rapidly changing images and may experience seizures. Anyone with a personal or family history of seizures, convulsions, or epilepsy should seek medical advice before playing.
If you experience any of the following while playing Happy Cans Sort: dizziness or lightheadedness, eye strain or blurred vision, uncontrolled eye or muscle movements, loss of awareness, disorientation, or seizure-like symptoms — should any of these symptoms occur, stop playing immediately and seek medical attention.
